Welcome to Today I am. Today I am ("Today I am," "we," "us," or "our") is a daily affirmations application designed to help users cultivate a positive mindset and focus on personal growth and daily motivation.

These Legal Terms constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you"), and Today I am, concerning your access to and use of the Services. You agree that by accessing the Services, you have read, understood, and agreed to be bound by all of these Legal Terms. IF YOU DO NOT AGREE WITH ALL OF THESE LEGAL TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY.

You must be at least 16 years old (or the minimum age of digital consent in your country, which is between 13 and 16 in the EEA) to use Today I am. If you are younger than that, you may use Today I am only with the involvement and consent of a parent or guardian.

1. Relationship to Apple's standard EULA

By downloading Today I am from the Apple App Store, you acknowledge that these Terms are concluded between you and Today I am only, and not with Apple Inc. However, your use of this App is also subject to the Apple Standard Licensed Application End User License Agreement (EULA). In the event of any conflict between these Terms and the Apple Standard EULA, these Terms shall govern.

2. User-generated content

Today I am allows you to create and store your own affirmations within the application, and to share them through other apps installed on your device.

  • Your responsibility: You are solely responsible for any content you write or any image you select from your device as a background. You agree that your content will not be illegal, infringe on third-party rights, or otherwise violate applicable law. Today I am assumes no liability for content you share outside the application.
  • Ownership: We do not claim ownership over the content you create. It is processed in accordance with our Privacy Policy.
  • Third-party platforms: Once you share content through another app, that content becomes subject to the terms and privacy policies of that platform.

3. Subscriptions and billing

Today I am may offer Today I Am Pro features via auto-renewable subscriptions.

  • Payment: Payment will be charged to your Apple ID Account at the confirmation of purchase.
  • Free Trials: Any unused portion of a free trial period, if offered, will be forfeited when the user purchases a subscription, where applicable.
  • Automatic Renewal: Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.
  • Account Charges: Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of the selected plan.
  • Management: You can manage or turn off auto-renew in your Apple ID Account Settings at any time after purchase.
  • Refunds: All refund requests are processed by Apple Support. Today I am cannot process refunds directly.
  • Restore Purchases: If you reinstall Today I am or change your iOS device, you can restore your previously purchased Today I Am Pro subscription using the 'Restore Purchases' button within the App's settings or paywall.
  • Consent to Share Consumption Data with Apple: By using Today I am and making in-app purchases, you consent to our sharing of data regarding your usage and consumption of purchased content with Apple, as part of our efforts to resolve refund requests. We ensure that such sharing is done in compliance with Apple's policies and only as necessary to process your requests.

4. Cancellations

  • Cancellation Process: You may cancel your subscription at any time. To avoid being charged for the next billing cycle, you must turn off the auto-renewal feature in your Apple ID Account Settings at least 24 hours before the current period ends.
  • Access After Cancellation: If you cancel your subscription, you will continue to have access to all Today I Am Pro features of Today I am until the end of your current billing period. Once the period expires, your account will automatically revert to the free version.
  • No Partial Refunds: We do not provide partial refunds or credits for any unused portion of a subscription period. All billing inquiries and refund requests must be directed to Apple Support, as we do not have the technical or legal ability to issue refunds on Apple's behalf.

5. Account deletion

We respect your right to privacy and data control. In compliance with Apple App Store Review Guideline 5.1.1(v), Today I am provides a straightforward way for users to delete their accounts:

  • Process: You may initiate permanent account deletion at any time directly within the "Settings" section of the App.
  • Data Removal: Upon deletion, the personal data Today I am stores on your device and the personal data we hold about you are erased. This action is final and cannot be undone. See the Privacy Policy for further detail.

6. Prohibited activities

You agree not to:

  • Circumvent, disable, or otherwise interfere with security-related features of the App.
  • Use the App for any illegal or unauthorized purpose.
  • Decipher, decompile, disassemble, or reverse engineer any of the software comprising the App.

7. Disclaimers & limitation of liability

  • "As-Is" Basis: Today I am is provided on an "as-is" and "as-available" basis. We make no warranties regarding the App's uptime or its effectiveness in habit or mindset modification.
  • Not a Medical Tool: Today I am is a personal growth tool. It is not intended to diagnose, treat, or cure any mental health disorder or medical condition, and is not a substitute for professional medical advice, counseling, or therapy.
  • System Dependencies: Our App's functionality depends on Apple's iOS. We are not liable for malfunctions caused by iOS updates or restrictions imposed by Apple.
